Credit Terms and Conditions

1. Introduction

These Credit Terms and Conditions govern applications for trade credit facilities offered by Lebotag to eligible business customers purchasing label printers, printing consumables, barcode labels, thermal labels, cable labelling solutions, and related labelling products.

Credit facilities are intended for qualifying businesses and organisations that require approved payment terms for their purchases. All credit applications are subject to assessment and written approval by Lebotag. Submitting an application does not guarantee approval.

2. Eligibility for Credit Facilities

Credit facilities may be considered for registered businesses, institutions, and other eligible organisations, subject to the nature of the application and the information provided.

When assessing an application, Lebotag may consider:

  • The applicant’s business registration and operating history.
  • Previous purchasing and payment history, where available.
  • Financial standing and ability to meet payment obligations.
  • The value and frequency of anticipated purchases.
  • The completeness and accuracy of the application documents.
  • Any other relevant commercial risk factors.

Lebotag reserves the right to approve, decline, or request additional information for a credit application, subject to applicable law.

3. Credit Application Requirements

Applicants may be required to provide documents relevant to the assessment of their creditworthiness and business identity. Depending on the application, these may include:

  • Business name registration certificate or certificate of incorporation, as applicable.
  • Valid KRA PIN certificate.
  • Current tax compliance documentation, where applicable or requested.
  • Valid business permit, where applicable.
  • Identification documents for the proprietor, directors, or authorised representatives, as relevant.
  • Business contact details and physical address.
  • Recent bank statements or other appropriate financial information.
  • Trade references or details of previous suppliers, where required.
  • Contact information for the applicant’s accounts or finance representative.

Lebotag will communicate the documentation required for the particular application. Personal and financial information submitted during the application process will be handled in accordance with applicable data protection requirements and our Privacy Policy.

4. Credit Assessment and Approval

Each credit application will be reviewed based on the information and supporting documents provided.

Following assessment, Lebotag may:

  • Approve the application.
  • Decline the application.
  • Request additional documentation or clarification.
  • Offer a different credit limit or payment period from the one requested.

Credit facilities become effective only after written approval and confirmation of the applicable credit limit, payment period, and other conditions.

Customers must not treat previous quotations, orders, or commercial discussions as evidence of an approved credit facility.

5. Credit Limits and Payment Periods

Each approved customer will be assigned a credit limit and payment period, where applicable. These details will be communicated in writing.

The approval may specify:

  • The maximum outstanding credit balance.
  • The applicable payment period.
  • The invoice date or other agreed date from which the payment period is calculated.
  • Any restrictions on eligible products or orders.
  • Any additional conditions applying to the credit account.

Customers must settle invoices within the approved payment period. Orders that exceed the available credit limit may require separate approval or advance payment before processing.

Unless expressly agreed in writing, credit approval for one transaction does not automatically apply to future transactions or increase the customer’s existing credit limit.

6. Invoicing and Account Reconciliation

Invoices issued for approved credit purchases will identify the relevant products or services, amounts payable, and applicable payment terms.

Customers should review invoices promptly and notify Lebotag of any discrepancy or billing concern.

Raising an invoice query does not automatically suspend the payment obligation for undisputed amounts. Any agreed adjustment or revised payment arrangement should be confirmed in writing.

Customers are responsible for keeping their account details accurate and ensuring that payments are correctly referenced so they can be allocated to the appropriate invoices.

7. Payment Obligations

Customers with approved credit facilities must pay all amounts due within the agreed payment period.

Payments should be made using the payment instructions officially provided by Lebotag. Customers should retain transaction confirmations and provide payment references when necessary for reconciliation.

Any change to the approved payment period or other credit conditions must be agreed in writing by Lebotag.

8. Overdue Accounts and Default

If an invoice remains unpaid after its due date, Lebotag may take reasonable steps to recover the outstanding amount, subject to applicable law and the terms of the credit agreement.

Depending on the circumstances, these steps may include:

  • Contacting the customer to request payment or clarify the account status.
  • Issuing payment reminders or a formal demand.
  • Suspending further credit purchases.
  • Requiring advance payment for subsequent orders.
  • Reviewing, reducing, or withdrawing the credit facility in accordance with the applicable agreement.
  • Pursuing lawful debt recovery procedures where necessary.

Any interest, late-payment charge, collection cost, or other additional amount will apply only where properly agreed or otherwise legally recoverable.

Customers experiencing payment difficulties should contact Lebotag promptly to discuss the account and any proposed payment arrangement. Any revised arrangement must be confirmed in writing.

9. Review, Suspension, and Withdrawal of Credit

Credit facilities may be reviewed periodically or when circumstances materially change.

Subject to applicable law and any existing agreement, Lebotag may review a facility where there are changes in payment performance, financial standing, business ownership, operating status, or other relevant risk factors.

Where appropriate, Lebotag may request updated documents or information to maintain the credit account.

Any suspension, adjustment, or withdrawal of an existing facility will be handled in accordance with the applicable agreement and legal requirements. Existing outstanding amounts remain payable under their applicable terms unless otherwise agreed or required by law.

10. Cancellation of Orders and Credit Purchases

Requests to cancel an order purchased on credit will be handled in accordance with the applicable order terms, Return Policy, and other relevant agreements.

Cancellation of an order does not automatically cancel outstanding payment obligations for goods already supplied or other amounts lawfully due.

Any credit note, adjustment, return, or refund relating to a credit transaction will be recorded against the customer’s account as appropriate.

11. Ownership and Risk in Supplied Goods

Ownership, delivery risk, and any rights relating to goods supplied under a credit arrangement will be governed by the applicable sale terms and Kenyan law.

Where Lebotag and the customer expressly agree to a retention-of-title arrangement, the applicable written terms will specify its scope and conditions.

Nothing in this policy gives Lebotag an automatic right to repossess goods or take other enforcement action outside the rights available under the applicable agreement and law.

12. Confidentiality and Data Protection

Information provided in a credit application may include business records, financial information, identification details, and contact information.

Lebotag will handle such information for legitimate purposes connected with assessing and administering the credit facility, managing customer accounts, preventing fraud, and meeting applicable legal obligations.

Information may be shared with authorised service providers, professional advisers, or relevant authorities where necessary and permitted by law.

For further information about the collection and handling of personal information, please refer to our Privacy Policy.

13. Disputes and Resolution

Customers should contact Lebotag promptly if they have a question or dispute concerning an invoice, payment allocation, credit limit, or account balance.

The parties will seek to resolve disputes through direct communication and reasonable efforts to reconcile the relevant records. Where a dispute cannot be resolved informally, the applicable agreement and Kenyan law will govern the available resolution process.

14. Amendments to These Credit Terms

Lebotag may review these Credit Terms and Conditions when its business procedures or applicable legal requirements change.

Changes to an existing customer’s approved credit arrangement will be communicated and implemented in accordance with the applicable agreement and law.

The credit terms expressly approved for an individual customer will apply to that customer’s account, subject to any valid subsequent written variation.
